Special building use

Anyone wishing to use a road beyond public use requires a special use permit from the lower road construction authority (KSJ / road administration).
These roads also include footpaths, cycle paths, parking areas and hard shoulders.

This applies, among other things, to
  • the erection of containers and scaffolding, machinery and equipment (construction site equipment)
  • the depositing of material
  • driving over sidewalks and footpaths
  • exceeding the permitted tonnage

A corresponding application should be submitted to the KSJ/road administration 14 days before the planned use. This will allow the necessary arrangements to be made or other areas to be involved if necessary.

Fees

A fee of at least EUR 18 is payable for processing. The administrative cost statutes of the City of Jena apply.
In addition, depending on the period of use and the area used, special use fees are charged in accordance with the special use fee statutes.

It is very important to note that if vehicle, cycle or pedestrian traffic is affected by special uses or excavations, an 'application for traffic regulation measures' must be submitted to the City of Jena (Mobility Department) in accordance with Section 45 of the Road Traffic Act.

For exemptions, an application must be submitted in accordance with Section 46 of the Road Traffic Act.

  • Anyone wishing to drive on a tonnage-restricted road with a vehicle exceeding the permitted tonnage must apply for a special permit in accordance with Section 46 StVO.
    The application must be submitted to the road traffic authority, mobility department of the city of Jena. It will then be decided after examination whether it is a special use or, for example, a permit-free special use for the purpose of operational maintenance of the property (delivery of fuels, furniture, etc.) and, if so, whether this can be approved with the requested deviation. In any case, a special permit in accordance with § 46 StVO must be issued before driving on the road.
  • If the facts of a special use are established, a special use permit in accordance with § 18 ThürStrG is required. This must be applied for from the municipal service. There is no legal entitlement to this permit. A discretionary decision is made in individual cases.
